Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Helix platform, operated by Anek ("we", "us", "our"). By accessing or using Helix, you agree to be bound by these Terms. If you are using Helix on behalf of a company, you represent that you have authority to bind that company to these Terms.

1. The Service

Helix is an AI-native enterprise work and decision management platform. It provides tools for task management, team organisation, role-based access control, audit logging, and workflow automation including WhatsApp-based task interaction. The platform is provided as a software-as-a-service (SaaS) product hosted on secure cloud infrastructure.

2. Accounts and Company Workspaces

Each user account is associated with exactly one company workspace. Company membership is set at registration and cannot be changed.

You are responsible for maintaining the security of your account credentials. You must not share your login credentials or allow others to access the platform using your account.

Company administrators are responsible for managing member access, roles, and permissions within their workspace. Anek is not responsible for actions taken by users within a company workspace.

You must be at least 18 years old and have the legal authority to enter into these Terms to use the platform.

3. Acceptable Use

You agree not to use the platform to:

  • Violate any applicable law or regulation
  • Upload, transmit, or store content that is unlawful, harmful, or infringes on the rights of others
  • Attempt to gain unauthorised access to other companies' data or to the platform's underlying infrastructure
  • Reverse engineer, decompile, or otherwise attempt to extract the source code of the platform
  • Use the platform in a way that could damage, disable, or impair its performance
  • Use automated scripts or bots to interact with the platform outside of supported integrations
  • Resell, sublicense, or otherwise make the platform available to third parties without our written consent

4. Your Data

You retain ownership of all content and data you create within the platform ("Customer Data"). By submitting Customer Data to Helix, you grant Anek a limited, non-exclusive licence to store, process, and transmit that data solely for the purpose of operating and improving the platform.

We do not claim any intellectual property rights over your Customer Data. We will not access your Customer Data except to provide the service, resolve technical issues, or as required by law.

5. WhatsApp Integration

The WhatsApp integration is an optional feature that allows users to interact with the platform via WhatsApp messages delivered through a third-party messaging provider. By opting in:

  • You consent to receiving messages from the Helix bot at the mobile number you provide
  • You acknowledge that message content passes through our messaging provider's infrastructure
  • You agree to comply with WhatsApp's Terms of Service and Acceptable Use Policy
  • You understand that standard messaging rates from your carrier may apply

You may opt out at any time by sending STOP to the bot or by removing your mobile number in your profile settings.

6. Intellectual Property

The Helix platform, including its design, code, features, and branding, is owned by Anek and protected by intellectual property laws. Nothing in these Terms grants you any right to use Anek's trademarks, logos, or other brand elements without prior written permission. Feedback and suggestions you provide may be used by Anek to improve the platform without obligation or compensation.

7. Availability and Service Level

We aim to maintain high availability of the platform but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance that results in temporary downtime. We will make reasonable efforts to notify users in advance of planned maintenance. We are not liable for any loss or damage resulting from service interruption.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Anek shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or business interruption, arising out of or related to your use of the platform.

Our total liability to you for any claim arising out of or related to these Terms or your use of the platform shall not exceed the amount you paid to us in the 12 months preceding the claim, or £100, whichever is greater.

9. Termination

You may stop using the platform at any time. We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, or if we are required to do so by law.

Upon termination, your right to access the platform ceases immediately. We will retain your data for up to 90 days to allow for recovery requests, after which it will be deleted in accordance with our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via the platform or by email. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the changes, you should stop using the platform.

11. Governing Law

These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
